New legislative instruments – such as the EU Regulation 679/2016 (better known as General Data Protection Regulation - GDPR) and the EU Directive 2016/943 on Trade Secrets – will enter into force and companies need to deal with these issues strategically. In order to successfully manage these challenges companies might act on three different fronts:
- implementing their organizational models and identifying managerial figures dealing with data management and trade secret protection;
- studying and adopting contractual models of non-disclosure in connection to business relationships with third parties;
- adapting technological data protection infrastructures.
